SiCap Industries Puts Potential Trademark Infringers on Notice

(EMAILWIRE.COM, November 06, 2006 ) Albany, NY -- As the brand name of their flagship product line grows, SiCap Industries has been plagued by attempts to infringe on the company's many registered trademarks. Perhaps the most potentially infringed upon trademark is that of "Sinus Buster". This brand was first released in 2003 as the world's first commercially available hot pepper (Capsaicin) nasal spray. Today the Sinus Buster brand includes eight natural nasal sprays targeting unique health issues including allergies, colds, headaches and even weight control. According to Wayne Perry, president of SiCap Industries, as the company's product line expands, so does their legal budget to protect the Sinus Buster name."When you have a product as successful as Sinus Buster, it's bound to attract certain opportunists that will use your brand name without permission. Usually it's an advertising matter, but we've also seen our share of direct trademark infringement. With the web, companies from other countries have copied our brand name and actually put it on their product's packaging. Then they market it on the web. We've seen pills, powders and even beverages using Sinus Buster as their brand name. We were the first, and we own the trademark on Sinus Buster, and we will litigate aggressively against anyone who infringes on that".In a recent case, SiCap was informed about a company that was marketing an herbal pill designed to relieve sinus problems. Although the company had their own brand name, they featured "Sinus Buster" as the name of the product on the labeling and in advertising.Within 24 hours after the issue was brought to their attention, the management team at SiCap moved fast with legal action. To avoid potential litigation, the company in question voluntarily removed the term "Sinus Buster" from all their packaging."We understand some people may want to grab onto the Sinus Buster name because of its' success. Lets face it. Sinus Buster is a winning name, and we own numerous trademarks for it and that's the law. Sinus Buster is our brand and it's important to protect your brand name aggressively especially when it's a money making machine," Perry adds.SiCap isn't the only company facing trademark infringement issues. The world famous jewler, Tiffany & Company, has been in litigation with onlie auction house, eBay over the sale of counterfeit items for more than five years. In 2004, Tiffany secretly purchased 200 items from various eBay sellers. In a January New York Times article, the paper reported that undercover agents working for Tiffany, bought 200 Tiffany branded items from various eBay sellers. According to Reuters and the Wall Street Journal Tiffany officials said 73% of the items purchased were documented as counterfeit. The case is presently winding its' way through the legal process."Protecting corporate intellectual property is a huge problem for many manufacturers thanks to the popularity of the web all over the world.
