Orlando Painters Say More Home Painters Running into Trouble over Neighborhood CC&R's

(EstateNewsWire.com, January 08, 2013 ) Orlando, Florida - One thing is certain, and that is that home design trends will continue to change, just as they always have. So what's hot today may not be so hot in a decade or so, and this applies to all areas of a home, including paint colors and styles.



So for more of today's homeowners, living in planned communities embracing changing paint color trends is becoming increasingly difficult.



It's even running them into real trouble with the homeowners associations due to community codes and restrictions that can be up four and even five decades old.



More commonly known as CC&R's, they are a set of rules drawn up by the original designers of a planned community and they govern what can and cannot be done to a home and its surrounding property. They cover everything too, all the way down to the species of plants that can be used in landscaping.



They're Included in a Rock Solid Contract



There's no getting around these rules either because anyone who purchases a home in a planned community today agrees to them in writing as part of the contract when they buy their home. They've been challenged in court already too, with the homeowners consistently coming up on the losing end.



So to find out more about CC&R's and the potential pitfalls that they hold for home painters, who better to talk to than a home painting professional who deals with them on a regular basis. He said that, “It's not just planned communities that have CC&R's. We do residential, industrial and commercial painting and some of our commercial clients based in office parks are surprised to learn that the colors and design schemes that they can use are also limited by these types of contracts. Some are worse than others, with some being quite restrictive. So we always do a check ahead of time and if there are CC&R's in place we gather the information that we need, so that we can work with the client within their boundaries to come up with a color design scheme that they're happy with. What's important keep in mind here is that they have a purpose and that is to support home and business resale values by ensuring a uniform look in a community or business complex.”

He went on to say that these types of rules are also commonly backed up by stiff fines so challenge in them is not only an exercise in futility but also expensive as well.



Finally, he pointed out that the only solution is to not live in a planned community with CC&R's, but then one has no recourse when his next-door neighbor decides to paint their home pink and park a junk truck in their front yard.
