Morgan and Morgan Attorney Scott Weinstein Comments on Plight of Homeowners with Toxic Drywall

(EMAILWIRE.COM, March 19, 2010 ) Fort Myers, FL - Insight from attorney Scott Weinstein of Morgan & Morgan, PA was featured in a recent Miami Herald article entitled “Courts start to figure out how to fix toxic drywall.” The article, written by Nirvi Shah, explores the struggles experienced by homeowners who have defective drywall in their homes.

Although it has been confirmed that defective drywall is at least partially responsible for the corrosion problems reported by 3,000 homeowners in 37 states, no government agency has endorsed a process for curing a home of the problems caused by the drywall. drywall.
In addition to corrosion, homeowners with defective drywall have also reported sulfur odors in their homes, blackening of jewelry, failure of air conditioning units and other appliances, headaches, breathing trouble, and other health problems.

In response to the large number of defective drywall claims filed by homeowners, the United States Judicial Panel on Multidistrict Litigation issued an order centralizing In re: Chinese-Manufactured Drywall Products Liability Litigation, MDL 2047, in June 2009. The MDL consolidated toxic drywall lawsuits in the Eastern District of Louisiana before Judge Eldon E. Fallon.

Attorney Scott Weinstein, who has been named to the Plaintiff’s Steering Committee for the Chinese drywall MDL, explains in the Miami Herald article, “Judge Fallon is focused on answering the question of what needs to be done to make these homes whole again.” It has not yet been determined what kind of actions would need to be taken to rid homes of the effects of defective drywall, but according to Weinstein, “our concept is to make the house as if it never had a defect.'' One method, which proposed to fix these homes without removing the tainted drywall through a process of dehumidification, conditioning and air filtration, has already been rejected by Judge Fallon.
