Resident Aliens fear Deportation for Tax Fraud Says Tax Solutions Network

(EMAILWIRE.COM, April 24, 2012 ) Los Angeles, CA -- Tax Fraud is the crime committed by taxpayers who deliberately defraud the government of tax. It includes overstating tax expenses and misdeclaration of income or business profit in the Tax return to reduce payment of tax. Along with the Naturalization and Immigration Service (now the United States Citizenship and Immigration Service), the Supreme Court ordered the deportation of two Japanese nationals who were granted permanent resident status in the United States. In the case KAWASHIMA v. HOLDER (615 F. 3d 1043, affirmed), the court ruled that the spouses Akio and Fusako Kawashima committed tax crimes qualified as “aggravated felonies.” The Supreme Court, held the spouses liable for: (1) “subscribing to a false statement on a tax return,” a violation of 26 U.S.C. § 7206(1) and (2) “aiding and assisting in the preparation of a false tax return,” a violation of 26 U.S.C. § 7206(2).

Tax Fraud, now an aggravated felony under US Tax Court
In the above case, the spouses Kawashima were held liable for “aggravated felony” for filing a fraudulent Tax Return. With proper Tax help, tax problem may be prevented. A taxpayer need not resort to acts of illegality to clear his Tax liability. Certain Tax options are available to address tax issues. Seek Tax help from Tax professionals to find appropriate solutions to the tax problems. Despite the spouses’ argument that the offense is outside the coverage of “aggravated felonies,” and not a deportable offense, Attorney General Holder stands firm in his decision. The spouses were found to have violated certain Tax laws by submitting inaccurate statement in their Tax Returns, a crime considered as an “aggravated felony” under 8 U.S.C. § 1101(a)(43)(M)(i) warranting deportation for erring resident aliens.

Deportation as penalty for tax crimes

The Supreme Court in its decision, affirmed the decision of the Ninth Circuit and ordered the deportation of the resident spouses Kawashima. Under the law, aggravated felonies can be a ground to deport an alien resident. Aggravated felonies include, “(i) involves fraud or deceit in which the loss to the victim or victims exceeds $10,000; or (ii) is described in section 7201 of title 26 (relating to tax evasion) in which the revenue loss to the government exceeds $10,000.” In addition, any alien convicted of a crime constituting aggravated felony may be deported to his home country. In this case, the spouses Kawashima sought Tax help with the Board of Immigration Appeals and the US Ninth Circuit Court, but without success. In the end, the Supreme Court rendered final the decision of the Ninth Circuit Court.
