(EMAILWIRE.COM, October 18, 2007 ) A judge on Monday has ruled that the city of Sacramento must pay developer Mohammed "Moe" Mohanna and other K Street landlords $42,052 to cover their attorney's fees in defending themselves against a city lawsuit.Superior Court Judge Loren E. McMaster previously ruled that the city is unlikely to prevail in its suit against K Street landlords including Mohanna, following a fire that destroyed one of the buildings involved in the swap. The city had been seeking to enforce a land transfer agreement that Mohanna had signed, but Mohanna and others declined to swap land following the fire. The judge ruled that the fire was a materially "adverse change" in the land swap agreement, meaning that the landlords didn't have to honor to the contract.The judge awarded the attorney's fees after he ruled that the city was not justified in filing a legal notice that Mohanna's and other owners' properties were the subject of a legal dispute, an official proceeding known as lis pendens.In the meantime, Mohanna has asked Mayor Heather Fargo to help settle the dispute, said Stan Devereux, a spokesman for the property owners.
